    "Marriage is the
    foundation of society and out of the nuptials there arises a social status. Marriage is therefore more than a mere contract, and to many, due to their religious belief and the nature of the marriage ceremony, it is a sacrament. The policy of the law is to fully protect the institution of marriage"  Calvert v. Calvert (1936) 130

    A marriage may only be entered into by one man and one woman. See R. C. 3101.01.


    Male persons of the age of eighteen years and female persons of the age of sixteen years, not nearer of kin than second cousins, and not having a husband or wife living, may be joined in marriage. See R. C. 3101.01(A).  For male persons under the age of eighteen years and female person under the age of sixteen years, special rules for obtaining a marriage license apply.


    To obtain a marriage license the parties to the marriage must personally appear in the probate court in the county where either resides, or if neither is a resident of Ohio, where the marriage is expected to take place. If neither is a resident of Ohio, the marriage must be solemnized only in the county where the license is obtained.
